Rental agreement

This website is operated by The Borrowed One. Throughout the site, the terms “we”, “our” and “us” refer to The Borrowed One. The Borrowed One offers this website, including all information and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, notices and policies stated here. These terms and conditions (the “agreement”) are a legal agreement between you and The Borrowed One. This agreement contains all the terms and conditions governing the rental of items from The Borrowed One via our website or social media platforms.

In consideration of the rental price to be paid by you, and the agreements set forth in these terms and conditions, The Borrowed One agrees to rent you the item as selected by you subject to the following;

  • You agree to pay the rental fee and all associated postage and professional cleaning costs as specified in your order. Once a rental is confirmed under these terms and conditions, through payment by you, you cannot transfer your rental of the item to another date.
  • If you need to cancel any order, cancellation must be received no later than 24 hours after an order is made on our website. All cancellations will have a $10 admin fee deducted.
  • No refunds will be given in the instance that Items hired online do not fit or you change your mind.
  • Though we try our best to ensure the description and measurements are accurate on each product, these are a guide only.

Damages

If insurance is not purchased at the website's checkout and the item is returned excessively stained, soiled, dirty, or has alcohol, make up or fake tan stains, an extra cleaning charge will be applied. This also applies in the event that small repairs are required. This will be determined at The Borrowed One’s discretion. 

You agree that no attempt to wash, dry clean or iron the garment will be made without consulting The Borrowed One prior. Insurance does not cover any alteration including, but not limited to hemming, stitching straps, or applying safety pins through the garments fabric. 

If you fail to return the rented item or the item is returned in a state that it is deemed unusable by The Borrowed One, you hereby authorise The Borrowed One to charge your selected payment method card 150% of the retail price of the item hired to you. The charge of 150% of the retail value represents the loss for the value of the item and the anticipated loss of revenue from further rental of the item.

Scheduling a booking

When renting an item, please ensure that the start date is that date that you wish to receive the item. Scheduling a rental well in advance of your rental date will help to ensure that your garment is received on time. If a rental booking is received within 3 business days (4 if rural delivery is required) of your desired usage/event date, this rental arriving will be at your own risk as enough time has not been allowed by you as the renter in the event of a courier delay. If you are booking after 3pm Wednesday for the weekend, you must select Saturday delivery at checkout.

Postage & returns

NZ Post overnight delivery service is the postage service that is used by The Borrowed One for the shipping of our items. The overnight shipping service is a target and is not guaranteed. If you are planning on traveling away from the postage destination address for your event, please let us know and we will try to accommodate rentals arriving in time. 

The tracking of any rented item is the responsibility of you as the renter. This can be tracked by yourself using the link sent once your parcel has been collected. The Borrowed Collective is not responsible for the tracking of any item, nor do we have any control over courier delays. NZ Post can be contacted directly if you have queries regarding delivery times or if you would like to arrange a collection from your local depot. They can be contacted by calling 0800 501 501.

Items rented must be returned to a postage office and sent for next day delivery prior to 3.00pm in the postage bag provided the day following the end of the rental period. This process must be completed in store/over the counter at the postage office to avoid delivery delays. 

If your garment is returned via the economy postage service, you are liable for any damage, loss, or theft. NZ Post does not cover any parcel sent on the economy postage service. If you put the parcel in a drop box you will be charged a late fee for every day it is not scanned.

If the prepaid return courier bag included in the initial package from The Borrowed One is lost, it is the responsibility of you as the renter to return the garment(s) at your own cost. The garment(s) must be returned by the expected return date. You must provide The Borrowed One with a tracking number that corresponds to the new postage bag. NZ Post overnight courier service must be used. You must ensure that an overnight courier sticker is placed upon the tracked parcel at the post shop. Tracked parcels without an overnight sticker may arrive outside of your rental window and this will incur a late fee to be paid by you as the renter. 

Pick ups

A pick up service is available for Taranaki based rentals. If ‘pick up’ is selected as the desired shipping option, it is the responsibility of you as the renter to deliver the item back to the same pick-up location. If ‘pick up’ is selected as the original shipping option, no return courier bag will be provided with the rental. If you would like to pick the item up, but return the item via a postage service, you must notify us of this at the time of the order and a return label will be generated to be used upon return. 

Refunds

A refund (less shipping) may be given if your rented item does not arrive on the date of your booking, and if the booking was confirmed more than 3 business days (4 business days if rural delivery required) prior to your usage/event date. Rentals that have been selected for Saturday delivery cannot be guaranteed, will be at your own risk, and are not eligible for a refund should they not arrive in time. 

If your rented item does not arrive on your booking start date, you are eligible for a refund (less shipping). Please note this is only if the parcel does not arrive on the booking start date, not the time of your event. 

If your event is scheduled to start during the day time, please ensure that the day before your event is the start date selected for the rental period. 

Only bookings that have been confirmed 3 business days prior to the event start date (4 business days if rural delivery is required) are eligible for a refund should they not arrive in time. If you redirect your item during the shipping period to a different pick up point/depot/address, a delay of 2-4 days may be added. If you redirect an item that does not arrive in time, you will not be eligible for a refund.

Refunds will not be given for any event that is canceled or if you are no longer able to attend the event that your item was originally rented for. 

Refunds will not be given in the event that you as the renter order the wrong size and the garment does not fit. 

Processed refunds will incur a $5 administrative fee to cover Shopify processing fees & administration. 

Failure to return

In the situation where a dress is not returned the day after the rental period ends, a late fee of $50 for every additional day that the item is retained will be incurred. This will continue to be charged at this rate until the item is received by The Borrowed One for up to 14 days. This is required to be paid back by you as the renter.

If the item is not returned within 14 days of the initially booked return date, this is deemed as a breach of the rental agreement. We have the right to charge 150% of the retail value of the item less any already paid late fees, as a result of the contract breach.

General

By agreeing to our terms of service you acknowledge that the ownership of all rented items remains at all times with The Borrowed One. You are the renter are only renting the selected item(s) for a sole period of time. 

You agree and acknowledge that you are responsible for any loss, damage, destruction for the rented item from the hired start date until it is returned to The Borrowed One. 

You agree to treat the rented items with respect and care. 

You agree and acknowledge that The Borrowed One determines with reasonable discretion whether a returned item in a damaged condition can be repaired with you as the renter liable to the cost of the repair. 

You agree and acknowledge that The Borrowed One determines with reasonable discretion whether a returned item in a damaged condition cannot be repaired and 150% of the item's retail value is charged to you as the renter. 

The Borrowed One reserves the right to take the required steps to ensure the amount owed by you as the renter is collected. This includes but is not limited to the use of a third party collection agency and/or legal action where required. If a third party collection agency is required to collect debt from you as the renter, this will be at the expense of you and commissioned amounts will be added to your invoice as the renter. 

The Borrowed One agrees to deliver the item that meets the product descriptor to you as the renter. This includes the specified colour, design, and size of the selected garment at the time of submitting the order. We agree to deliver the item to the address noted on the order and on the date in which delivery has been requested. In the event that a garment is received that does not match the selected garment in the colour, design, and size specified at the time of ordering, you as the renter agree to contact The Borrowed One within 24 hours of the garments arrival via email at hello@theborrowedone.com.

You agree to return the product provided in its original state, in the return courier bag included in the order. 

As a rental company, it is rare that the item you have ordered is an unworn garment. Slight signs of wear are common for rented garments so please consider that there may be subtle imperfections such as small marks or pilling present. 

The Borrowed One does their best to ensure that all garments received by you as the renter are clean and in a ready-to-wear condition. All garments are examined prior to shipping however if your items is received in a damaged condition, please notify The Borrowed One at hello@theborrowedone.com within 24 hours of the garments’ arrival. 

 

* a business day is defined as before 3pm when our courier arrives. Eg: If you booked Monday at 5pm your first business day starts Tuesday.
